Fo-Mi Policy

1. Introduction

  • Welcome to the Surf4Life (Pty) Ltd Mobile Softphone Application “Fo-mi”. By downloading, installing, or using the App, you agree to comply with and be bound by the following Terms and Conditions ("T&Cs"). If you do not agree to these T&Cs, please do not use the App.

2. License to Use the App

  • Surf4Life grants you, as a paying client, a limited, non-exclusive, non-transferable, revocable license to access and use the App for your personal or business communications. This license is subject to your compliance with these T&Cs and any applicable subscription or service agreements.

3. User Responsibilities

  • You agree to use the App in compliance with all applicable laws and regulations.
  • You must ensure that your use of the App does not infringe on the rights of others, including but not limited to privacy and intellectual property rights.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Restrictions

  • You may not modify, reverse engineer, decompile, or disassemble the App.
  • You may not use the App to engage in any illegal activities or to distribute any malicious software.
  • You may not sublicense, sell, or distribute the App to third parties without prior written consent from Surf4Life.

5. Service Availability

  • Surf4Life does not guarantee uninterrupted or error-free operation of the App.
  • Service may be temporarily unavailable due to scheduled maintenance, upgrades, or unforeseen issues. Surf4Life will make reasonable efforts to notify users of any downtime in advance.

6. Data Usage and Privacy

  • The App may use data from your mobile device, including voice data, for the purpose of providing its services.
  • Your data is subject to the Surf4Life Privacy Policy, which outlines how your information is collected, used, and protected.

7. Fees and Charges

  • Any fees or charges associated with the use of the App will be clearly communicated to you at the time of purchase or subscription.
  • You are responsible for any data charges incurred while using the App, as per your mobile service provider's rates.
  • Any package purchased on “Fo-Mi” has a 30-day validity period from date of purchase and will cease to exist after the stipulated time frame.
  • All “Fo-Mi” packages use a per minute billing method and are billed at a rate of R0.39c per minute.

8. Limitation of Liability

  • Surf4Life is not liable for any direct, indirect, incidental, or consequential damages arising from your use of the App.
  • The App is provided "as is," without any warranties, express or implied, including but not limited to merchantability or fitness for a particular purpose.

9. Termination

  • Surf4Life reserves the right to terminate or suspend your access to the App at any time, with or without cause, and without notice.
  • Upon termination, your rights to use the App will cease immediately.
  • Any users’ number that remains inactive for a period longer than 90 days will be suspended and made available to use for new customers. Should the customer wish to retain their number after 90 days of no use, the number will be subject to availability.

10. Governing Law

  • These T&Cs are governed by and construed in accordance with the laws South Africa, and any disputes will be resolved in the courts of South Africa.

11. Changes to the T&Cs

  • Surf4Life reserves the right to modify these T&Cs at any time. Any changes will be effective immediately upon posting the revised T&Cs in the App or on our website. Continued use of the App after such changes constitutes your acceptance of the new T&Cs.
